described as a smiling well-behaved and

polite young girl who took piano and

dance lessons she was also somewhat of a

tomboy and did not mind getting herself

dirty while playing basketball and

football as sisters jesse and maddie

were pretty close and did everything

together in fact jessie described maddie

as her other half which is why what

jose catholic school along with her

sister they both had a routine that they

would follow every day after school they

would do their homework practice piano

for about 20 minutes and then go out to

play until dinner this day was no

different only that maddie went out

lot of homework a few minutes later she

came back looking for golf balls to play

helped maddie look for a while before

maddie's hands were clutching on the bed

frame when she was found meaning that

she had actually been alive when she was

shoved there

investigators found both the baseball

bat and the knife hidden in josh's
00:06:14
closet

there were also cans of air fresheners

on his nightstand along with freshly
00:06:20
burned incense which investigators
00:06:23
believed might have been used to mask
00:06:25
the smell of the decomposing corpse

what's more they found one of maddie's

missing persons flyers placed on josh's

nightstand what's interesting about this

case was that the police had actually

searched josh's house three different

times but didn't find anything

he smashed her head three times he did

this with a baseball bat and then shoved

investigators that maddie was still

moaning when his dad came home and in a

panic he pulled her out and jabbed her

in the chest and neck with a pen knife

before hiding her under the bed again

was on top of her

reading and working on computers he

showed no signs of being troubled and

was liked by all the kids in the

neighborhood so why did he do it josh

insisted that he killed maddie out of

fear of his father which made many

people wonder just how bad could the

situation at home have been to make a

teenage boy commit such an awful crime

steve as frightening intimidating and

sometimes overbearing saying that she

and josh walked on eggshells around the

house she explained that steve didn't

like josh playing with girls younger

admit that he probably should have

handled some things differently with his

son but said that he didn't think it

would have made much of a difference

josh's trial began in july 1999 with the

prosecution presenting a great deal of

evidence against him including the

baseball bat the knife and his tennis

shoes which were stained with maddie's
00:09:55
blood but the most damning piece of
00:09:57
evidence was josh's confession the

prosecution argued that josh had planned
00:10:03
to assault maddie and that's why he had
00:10:05
removed some of her clothes it was
00:10:07
alleged that josh's main target had
00:10:09
actually been maddie's sister jessie
00:10:11
because her picture had been found in
00:10:13
his room the defense denied this
00:10:15
allegation claiming that maddie's
00:10:17
clothes came off when josh was dragging

her into his room stating and i quote

joshua phillips is not a monster but

because of an act that started as an

accident and deteriorated through panic

that bordered on madness

now what really surprised everyone was

that josh's defense lawyer didn't call

in any witnesses to testify on josh's

behalf in fact the entire defense was

just a closing argument the jury only

took a little over two hours to

deliberate and find josh guilty of

first-degree murder despite being only

14 at the time of the crime he was

sentenced to life in prison without the

possibility of parole years later when

josh was asked how he was able to

function for an entire week after

committing such an awful crime he said

that he was putting himself in a fantasy

during the entire time i was

that nothing had happened

and uh that's my uh that was my defense

for everything when i was a kid was if

and uh it worked a couple times and

that's why i believed it inherently over

the years josh and his family have made

several attempts to appeal his sentence

after a supreme court ruled that it was

unlawful to sentence a minor to life in

prison without parole he was granted a
00:11:32
hearing in 2016 but that didn't really
00:11:34
work in his favor as he ended up being
00:11:36
re-sentenced to life in prison still his
00:11:39
next review is set for 2023 and maddie's
00:11:42
family will have to go through the pain
00:11:43
again to ensure that maddie's killer
00:11:45
does not get out
