a pretty solid couple and the thing that00:02:18
bonded the most was their love for goth00:02:21
subculture sophie's dad described the00:02:24
young couple they're both intelligent00:02:26
sensitive kids they're not the sort of00:02:29
people to get into trouble but they have00:02:31
had problems in the past because they00:02:33
stand out the makeup community is a00:02:35
close-knit one00:02:36

sophie and rob had been beaten to a pulp00:03:57

very serious assault we looked the level00:04:12
of bleeding the swelling the fact that00:04:13
we're both unconscious and the fact that00:04:15
they couldn't really differentiate the00:04:16
male and female00:04:19
the police's first step was to identify00:04:21
the victims searching through their00:04:23
pockets they found robert's name and00:04:25
address sophie had no idea or credit00:04:27
cards on her so the police headed00:04:29
straight to robert's family they said00:04:31

indeed both sophie and rob were in a00:06:04
coma sylvia could barely recognize her00:06:08
daughter on the hospital bed her eyes00:06:10
were badly bruised her face was swollen00:06:13
and a big chunk of her hair was missing00:06:17
they'd both been severely kicked by the00:06:19

alcohol bottles and red marks all over00:07:04
the skate park as no id could have been00:07:06
gathered from the criminal scene the00:07:07
police then went door to door asking00:07:10
people for any relevant clues and00:07:12
looking for key witnesses but remember00:07:14

leading the investigation decided to00:07:37
leave the inquiry in the hands of00:07:39
younger detectives00:07:40
the junior officers would end up00:07:42
building a better rapport with the00:07:44
locals and some of them started opening00:07:46
up meanwhile fear and shock were00:07:49
spreading throughout makeup as people00:07:51
were learning about last night's00:07:52
horrifying attack unprovoked brutal and00:07:56
downright evil my parents were worried00:07:58

names from the other resident teens it00:08:22
was clear that there were five key00:08:24
individuals involved in the assault00:08:25
certainly on robert maltby and probably00:08:28
involved in the subsequent assault on00:08:29
sophie lancaster00:08:31
these were all teenagers between 15 and00:08:33
17 years old one witness said they were00:08:36
running over and just keeping her in the00:08:38
head and jumping up and down on her00:08:42
another witness who adhered to the00:08:43
teen's twisted views on goths rang up00:08:46
999 saying we need an ambulance at bake00:08:49
up park this mosher has just been banged00:08:52
because he's a mosher yeah this guy was00:08:54
blaming the attack on the victims00:08:56
apparently after sending rob and sophie00:08:58
to sleep the five teens celebrated their00:09:01
attack telling friends that they'd done00:09:03
something good and inviting them to go00:09:05
see the victims these two moshers nearly00:09:08
dead in makeup park you want to see them00:09:09
they're a right mess00:09:11
finally the police were able to bring00:09:13
the five boys into custody and news of00:09:16
their names traveled fast throughout00:09:18
bacon00:09:19
by the sunday evening i had all their00:09:21
names i knew exactly where they lived00:09:24
and knew that they were trouble makers00:09:26
by monday morning all five boys were at00:09:28
the police station being questioned they00:09:31
all denied conducting a group attack on00:09:33
the young couple but there were five of00:09:35
them so not all their stories were in00:09:37
sync some admitted they were in the park00:09:40
that night some even said they did hit00:09:43
rob but only once00:09:45
as the police also did a background00:09:47
check on the five they discovered that00:09:48
sixteen-year-old ryan herbert and00:09:51
fifteen-year-old brendan harris had a00:09:53
long history of violence00:09:56
whilst it was hard to imagine people of00:09:58
that age being involved in such a00:10:00
violent assault what we knew certainly00:10:01
about herbert and harris is that they've00:10:03
been involved in a very similar incident00:10:04
whereby they'd kicked and punched00:10:06
somebody into the ground meanwhile the00:10:09
forensic team went to the boys homes to00:10:11
retrieve their clothing from friday00:10:12
night00:10:13
immediately they found blood on00:10:16
herbert's jeans and that went hand in00:10:18
hand with what some of the other00:10:20
witnesses had seen some of the boys were00:10:22
washing something red off their hands00:10:24
and faces at a hose pipe at the gas00:10:26
station where they'd initially00:10:28
befriended rob and sophie unfortunately00:10:32
none of the local cctv worked the police00:10:35
still had a long way to go in order to00:10:37
convict the five boys but as the young00:10:40
officers continued interrogating the00:10:43
other local youth it quickly became00:10:45
certain that those were the five boys00:10:48
who attacked rob however in sophie's00:10:50
case the police had to go another way to00:10:52
prove the boy's involvement dci holden00:10:54
got a forensic pathologist to visit00:10:57
sophie in the hospital00:10:59
what is the case is that medical00:11:00
practitioners at hospitals can give00:11:02
expert advice on what the injuries are00:11:04
whereas a pathologist can actually give00:11:06
experts advice on how those injuries00:11:07
might have been caused a pathologist00:11:09
quickly concluded that sophie's head was00:11:11
kicked by at least two people00:11:16
around that time rob came out of the00:11:18
coma making very slow recovery and00:11:21
remembering nothing from the night of00:11:23
the attack but not the same could be00:11:25
said about sophie her condition was00:11:27
deteriorating every single day on august00:11:30
21st 10 days after the attack she was00:11:33
given a brain scan00:11:35
we heard the news that they'd done um a00:11:38
brain test on sophie and that there00:11:42
wasn't any activity00:11:45
and00:11:46
then you know it's00:11:48
you know it's serious00:11:51
sophie was never going to regain00:11:53
consciousness so her family had to make00:11:55
the toughest decision one could ever00:11:58
make pulling the plug on their00:12:00
daughter's life support00:12:04
they pulled the curtains around00:12:06
anyway the first time you know00:12:09

the first time that you can hold them00:12:18
because they've got so many things on00:12:20

a minute later sophie died00:12:26

when sophie passed away and we learned00:12:30
that she had died the big change for us00:12:32
is that it was no longer just an assault00:12:34
investigation it was a murder00:12:36
investigation the police were more00:12:38
determined than ever to convict the five00:12:41
boys for their heinous deeds murder00:12:44
could mean life in prison so this00:12:47
motivated the boys who did less to speak00:12:49
against each other and distance00:12:51
themselves from the deed00:12:53
the account that we got from brendan00:12:55
harris was that the assault on silver00:12:56
lancaster was completely down to ryan00:12:58
herbert the boy's stories matched the00:13:00
forensic evidence herbert had by far the00:13:03
most evidence on his clothes holden said00:13:05
the clothes looked as if he'd been00:13:07
stomping in pools of red paint both00:13:10
herbert and harris were in juvenile00:13:12
prison and the police were now00:13:13
monitoring herbert's calls before long00:13:16
they got enough evidence of his00:13:17
involvement in sophie's murder while00:13:19
herbert was talking to his mom his00:13:21
mother was saying to him that even00:13:22
though sophie lancaster's dad had00:13:24
nothing to worry about00:13:25
if he wasn't involved to which he00:13:27

on the way to the trial the police00:13:30
bugged their van and heard herbert brag00:13:32

know how she took her coffee while rob00:14:25
worked hard to recover from his worst00:14:27
nightmare the police were still working00:14:30
to give the five teens the punishment00:14:32
they deserved herbert's defense team00:14:34
argued that they should only be charged00:14:36
with manslaughter as he was autistic but00:14:38
this proved to be one big lie got a very00:14:42
renowned national and international00:14:44
expert on autism who actually came to00:14:46
lancashire prior to the trial and did a00:14:48
real assessment of him00:14:50
and her assessment was that he wasn't00:14:51
autistic in march 2008 the boys trial00:14:54
finally began it was a tough experience00:14:56
for sophie and rob's families who had to00:14:58
face their criminals families to00:15:01
everyone's shock herbert admitted on the00:15:02
first day that he was responsible for00:15:04
the death of sophie this let the other00:15:07
three boys bar harris off the hook in00:15:09
the case of sophie's murder herbert's00:15:12
admission and play diluted the evidence00:15:15
against them and what their defence team00:15:17
were arguing is that this is two00:15:18
separate incidents their clients were00:15:20
